Embarq issued commercial agreements to all its ISP customers.
This commercial agreement will replace group buying agreements as well as the tariff. Thanks to a favorable ruling at the FCC, ILECs no longer have to tariff DSL. It can be offered as a commercial wholesale private arrangement.

    I will identify the latest of activities for the DSL for ISP product.

1.    3/31/06    Price reduction for the 1.5 Mbps services and higher

2.    June 06    Non-Disclosure Agreement (NDA) has been distributed to
the ISPs for signature.  With the NDA, the ISP will be included in a distribution list for DSLAM roll out information.  This will allow the ISPs to target new markets, prior to DSL availability.

3.    July 06    Embarq is in the processing of pulling the DSL End User
services from the Tariff.  This will allow for ease of product/pricing changes.  At this time there are no plans to change the product but going forward, only one pricing schedule will exist.  The schedule will mirror the 2500+, 5 year term rate that is in effect today.  Schedule completion is 8/3/06.

Q. I received a DSL Commercial Service Agreement For ISPs from Embarq.  Do I need to return this to them as a member of FISPA?

A.   No more group contracts with Embarq.
Everyone gets the group rate via the commercial contract.

We had a conference call today with some of the folks in the Embarq wholesale group.  Present were Mike Higgens (Embarq), Andy van Slyke  (Embarq) Charely Maleponte (Embarq wholesale product manager), Mike from Wcoil and myself.

Wholesale DSL commercial agreement: if that is not signed by aug 4, you will be able to continue placing orders and your rates will not be impacted until November - at which point you may be negatively impacted.

At this point - signing the contract gives you what you have through the FISPA group buying.  I would talk to your account manager to confirm.

They did provide some wiggle room by saying that you can request to negotiate directly with Embarq (via your account rep) an agreement potentially different than the commercial agreement.  For smaller accounts - it didn't sound like there was much if anything that would change.

Other fispa opportunities with embarq: we all agreed that there was an untapped opportunity to provide benefits/promotions to fispa members.   This is an area that we need suggestions from the members.  Some ideas were discounts with embarq logistics, further modem promotions, ...   (need some help from the membership here).  We agreed to discuss it again but it is our responsibility to provide some input/ideas on things that we would like to see.

They are in the process of reworking the high cap atm pricing due out q4 06.  no indication on what that will look like yet.

There was interest in creating an isp forum (meeting once a year) among embarq reps/manages/directors and ISP/CLEC that do business in Embarq territory.  They already do this with the CLEC's and it is a valuable meeting to be able to overlap with other ISP business owners as well as have brief but direct access to the upper management. 

 They are also pushing hard to make their Ethernet product available (talk to your embarq rep for details)

 There was mention that Embarq's participation on the list was nonexistent.  Their position is that their reps are in touch with their accounts so communication via the list is not a priority for them.
